Prison death lawsuit alleges corrections staff failed to stop assault on Nicole Rathmann

A complaint was filed earlier this month stating that Nicole Rathmann was “essentially given the death penalty” in a beating by a fellow inmate. He repeatedly hit her with a sock stuffed with soap and locks. According to the complaint, correctional officers and other prison staff did not attempt to stop Rathmann’s beating or offer medical help. Rathmann, 33 years old, was found unresponsive and in a seizure-like state. She was taken to Merit Health Central hospital in Jackson where she died on Aug. 23, 2018. According to the complaint, doctors discovered that Rathmann had suffered a stroke and internal bleeding. Carlos Moore, a Grenada-based attorney filed the wrongful Death suit on behalf Rathmann’s dad, Kent Rathmann. As defendants, the complaint names Pelicia Hall (ex-Mississippi Department of Corrections Commissioner), Ron King (CMCF Superintendent), Warden Dean Epps, and multiple other unnamed prison staff. The lawsuit seeks at least $3,000,000. Grace Fisher, MDOC communications director, declined to comment on the litigation. Rathmann was sentenced to six years in prison for the sale of methamphetamine. The conviction was from 2013. Rathmann was the sole woman and one of 16 people who died in prison while she was held at a state prison. She was one of 16 people — and the only woman — to die in a Mississippi state prison in August 2018.
